Terms of Service

The agreement between you and Kula when you use the service or buy a paid plan.

These terms govern your use of Kula (kulamail.com, app.kulamail.com, the API and the MCP server) and the purchase of paid plans. Kula is operated by Eventuallycoding, a sole proprietorship registered in France (see the legal notice), referred to as "Kula", "we" or "us".

By creating an account or using the service, you accept these terms, the Acceptable Use Policy and the Data Processing Agreement, which are part of them. If you use Kula on behalf of a company, you confirm that you can bind it, and "you" means that company.

1. The service

Kula is a platform for sending email: campaigns to lists and segments, automated sequences (flows), and transactional emails sent through the API. It includes signup forms, contact management, delivery and engagement reports, deliverability safeguards, an API, webhooks, an MCP server for AI agents and, on paid plans, an AI assistant.

Features change over time. We may add, change or remove features; if we remove a feature that is significant to a paid plan, we tell you at least 30 days in advance.

2. Accounts and spaces

  • You must be at least 18 years old and give accurate information when you sign up.
  • You are responsible for the activity of your account, its members, its API keys and the AI agents you connect to it. Keep your login email and your keys secure, and tell us at once at support@kulamail.com if you suspect unauthorised access.
  • An account can hold several spaces, one per brand or product. Each space has its own domains, contacts and sending reputation.
  • One person or company may not open several accounts to get around a limit, a pause or a suspension.

3. Your content and your contacts

Everything you bring to Kula stays yours: your contacts, lists, emails, templates and files ("your content"). You give us the right to host, copy, process and send your content only as needed to provide the service to you.

For the personal data of your contacts and recipients, you are the controller and Kula is your processor. The Data Processing Agreement governs that processing. You are responsible for having a lawful basis for every email you send, in particular the consent of your recipients for marketing, and for the content of your emails, including the information the law requires in them (your identity, your postal address where required, an unsubscribe link).

You can read your contacts and their activity through the dashboard and the API at any time. On request, we provide an export of your contacts.

4. Sending rules

Email only works when every sender behaves. Your use of Kula must follow the Acceptable Use Policy. In short: send only to people who asked to hear from you, from a domain you control, and keep bounces and complaints low.

To protect your recipients, your reputation and that of the other customers, Kula:

  • sends only from domains you have verified, and ramps up the volume of a new domain progressively;
  • limits sending to contacts imported in bulk until they show engagement;
  • removes from your sending the addresses that bounced, complained or unsubscribed;
  • pauses the marketing emails of a space automatically when its bounce or complaint rates exceed the thresholds of the Acceptable Use Policy. Transactional emails keep going. Sending resumes after we review the space with you.

We may review, delay or refuse to send messages that appear to break these terms or the law, and we may suspend an account during an investigation. We do not read your emails as a matter of course; we look at them when an automatic signal, a complaint or a report gives us a reason to.

5. AI assistant and AI agents

The assistant. Paid plans include an AI assistant in the dashboard, within a monthly message allowance. It can read the data of the space you are working in and create or change content there (domains, lists, segments, flows, emails) on your behalf. It runs on a model provided by Anthropic, listed in our subprocessors, which does not use your conversations to train its models. Using the assistant is optional.

AI agents (MCP). You can connect your own AI agent to Kula through MCP. The agent acts with the permissions you grant it when you connect it, and its provider is chosen by you and works under its own terms, not ours.

Your responsibility. AI output can be wrong. You are responsible for reviewing what the assistant or your agent prepares, and for what you send. Neither the assistant nor an agent can email your contacts: their test emails go only to the members of your account, and a campaign or a flow they prepare goes out only once a member approves it in the dashboard.

6. Plans, billing and payment

Merchant of record. Paid plans are sold by Creem, which acts as our reseller and merchant of record. Creem processes the payment, issues the invoices and collects the sales tax (VAT or equivalent) that applies in your country. Its terms apply to the payment itself.

Free plan. The free plan includes a monthly allowance of emails, one space and no AI assistant, and adds a small "Sent with Kula" badge to the footer of your emails. Sending stops for the month once the allowance is used.

Paid plans. Prices, the number of emails included each month and the price of additional emails are shown on our pricing page, in US dollars. A paid plan is a monthly subscription, billed in advance, that renews automatically until you cancel it. Emails beyond those included are paid from a prepaid credit balance, which you top up from the dashboard. When the credit balance is used up, sending stops at the included allowance until you add credit.

Sending caps. To limit the risk of unpaid usage, a paid account has a monthly sending cap, which increases with each period paid. Contact us if you need a higher cap.

Failed payments. If a payment fails, marketing emails stop at once and transactional emails stop after 7 days, until the payment goes through.

Price changes. We may change our prices. A new price applies to an existing subscription from the next renewal after at least 30 days' notice by email. If you do not accept it, you can cancel before it applies.

7. Cancellation, withdrawal and refunds

Cancellation. You can cancel your plan at any time from the billing page. It stays active until the end of the period you have paid for, then your account returns to the free plan.

Right of withdrawal (consumers). If you are a consumer in the European Union, you normally have 14 days to withdraw from an online purchase. Because Kula is a digital service supplied immediately, by starting a paid plan you ask us to begin providing it right away, and you acknowledge that you lose your right of withdrawal for the part of the service already provided. Within 14 days of your first purchase you can still withdraw by writing to support@kulamail.com; we then refund the price paid minus the value of the service already provided (in particular the emails already sent).

Refunds. Outside the right of withdrawal, fees are not refundable: emails sent and credit consumed cannot be refunded, and a cancellation does not refund the current period. Unused credit is not refunded on cancellation, except where the law requires it. If something went wrong on our side, write to us: we will look for a fair solution. No refund is due when we suspend or close an account for a breach of these terms.

8. Availability and support

We work to keep Kula available and to deliver your emails quickly, but we do not guarantee uninterrupted service, and we do not offer a service level agreement. Delivery to the inbox ultimately depends on the receiving providers (Gmail, Outlook…), which we do not control.

We back up the database continuously and keep the backups for 7 days. We still recommend that you keep your own copy of important content.

Support is provided by email at support@kulamail.com. We aim to answer within 3 business days.

9. Suspension and termination

By you. You can stop using Kula at any time. To close your account and delete its data, cancel your plan, then write to support@kulamail.com from the email of an account owner. You can delete a space yourself from its settings.

By us. We may suspend or close an account, with immediate effect where needed, if it breaks these terms or the Acceptable Use Policy, if it puts the service, our sending reputation or other customers at risk, if a payment remains unpaid, or if the law or an authority requires it. Except in urgent cases or when the law prevents it, we tell you why and give you a chance to fix the issue. Accounts closed for sending spam are not reinstated.

What happens to your data. When an account or a space is deleted, its contacts, emails and reports are deleted from our systems within 30 days, and disappear from backups within the following 7 days. We keep the addresses that hard-bounced, which protect every sender from addresses that no longer exist, and the information we must keep by law (for example billing records).

10. Intellectual property

Kula, its software, design and brand belong to us. These terms give you a right to use the service, not a right to its code or brand. If you send us suggestions, we may use them freely.

11. Liability

Kula is provided "as is", within the limits allowed by law.

If you use Kula for your business: we are not liable for indirect damages, such as loss of profits, revenue, data or reputation, nor for the content you send, the actions of your AI agents or the decisions of receiving email providers. Our total liability for all claims is limited to the amounts you paid us in the 12 months before the event that caused the claim. You will compensate us for any claim by a third party resulting from your content or from your breach of these terms, the Acceptable Use Policy or the law (in particular anti-spam and data protection law).

If you are a consumer: we are liable for the foreseeable damage caused by our failure to perform these terms, under the law that protects you.

Nothing in these terms limits liability for fraud, gross negligence, death or personal injury, or any liability that cannot be limited by law.

12. Changes to these terms

We may update these terms. For a material change, we email account owners at least 30 days before it applies; other changes apply when published. If you do not accept a change, you can close your account before it applies. Continuing to use Kula afterwards means you accept the new terms.

13. Law and disputes

These terms are governed by French law. Before going to court, write to us: most issues are solved by email.

If you are a professional, the courts of Lyon, France, have exclusive jurisdiction. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you can bring a claim before the courts of that country or of France.
