Acceptable Use Policy
Every customer of Kula shares the same sending infrastructure, and inbox providers judge senders by their behaviour. One sender who spams harms the deliverability of everyone. This policy is part of our Terms of Service; breaking it can lead to the suspension or closure of your account.
1. Send only to people who asked for it
- Marketing emails (newsletters, campaigns, promotional flows) go only to people who gave you their consent to receive them, or where the law of the recipient allows it without consent (for example an existing customer, for similar products, with a way to opt out). You must be able to show where and when each contact subscribed.
- Transactional emails are messages a person expects because of something they did: a receipt, a password reset, an account notification. Do not use the transactional stream to send marketing: it is not paused when your marketing is, and using it that way to get around a pause is a breach of this policy.
- We recommend double opt-in, which Kula's signup forms use: the subscription counts only once the person confirms it from their inbox.
2. Lists you may not use
You may not send to addresses that did not opt in to hear from you, in particular lists that are:
- bought, rented, borrowed, shared or exchanged, whatever the seller says about their consent;
- scraped from websites, directories or social networks, or guessed;
- appended or enriched with addresses from a third party or an address-finding tool;
- collected for another purpose or by another company (for example from a contest or a partner) without explicit consent to your marketing;
- old lists you have not emailed for a long time (more than about 12 months), unless you first confirm the contacts' interest.
Kula limits the sending to contacts imported in bulk until they show engagement. Do not try to get around that limit, for example by splitting an import or re-importing contacts.
3. What every email must include
- A sender you control: Kula sends only from domains you have verified. Do not impersonate another person, brand or organisation.
- A truthful From name, subject line and content.
- For marketing emails: a working unsubscribe link (Kula adds one, along with one-click unsubscribe headers) and the information the law of your recipients requires, such as your identity and postal address.
- Unsubscribes take effect immediately in Kula. If you also manage contacts elsewhere, honour unsubscribes there within 2 business days, and do not re-subscribe someone without their new consent.
4. Keep bounces and complaints low
Kula watches the bounce and complaint rates of each space over the last 7 days. Healthy senders stay well under these levels:
| Measure | Keep it under | Marketing pauses above |
|---|---|---|
| Spam complaints | 0.1% | 0.3% |
| Hard bounces | 2% | 5% |
| Gmail spam rate (Google Postmaster Tools, per day) | 0.1% | 0.3% |
Above the pause level, Kula pauses the marketing emails of the space automatically and alerts its owners and admins. Transactional emails keep going, and the campaigns in progress wait in the queue: nothing is lost. We review the space with you before sending resumes. Repeated pauses, or a single pause with clear signs of a bought or scraped list, can lead to the closure of the account.
Addresses that hard-bounce, complain or unsubscribe are removed from your sending automatically. Do not try to send to them again, for example through another space or another account.
5. Content you may not send
- Anything illegal, or that promotes illegal activity.
- Phishing, malware, deceptive links, or attempts to collect passwords, payment or identity data.
- Sexually explicit content, and any content involving minors in a sexual way.
- Hate speech, harassment, threats, or content inciting violence.
- Content that infringes the intellectual property or the privacy of others.
- Scams and deceptive offers: get-rich-quick schemes, pyramid or multi-level marketing recruitment, fake prizes.
- Gambling, betting and lotteries, payday and high-interest loans, debt collection and credit repair, cryptocurrency or forex trading offers, unlicensed financial advice.
- Sale of prescription drugs, controlled substances, weapons, tobacco or vaping products, or health supplements making medical claims.
- Sale of followers, likes, reviews or traffic.
Do not put sensitive data in emails or contact attributes (health data, payment card numbers, government identifiers, passwords), except what your service genuinely requires and the law allows.
If your business is close to one of these categories and you are unsure, write to us before sending.
6. Use of the service
- Do not create several accounts or spaces to get around a limit, a pause or a suspension.
- Do not test, scan or attack the security of Kula, or try to access data that is not yours.
- Do not overload the service: respect the API rate limits and the sending limits of your plan.
- Do not resell the service or let third parties send through your account as if it were a service of your own, unless we have agreed to it in writing.
- The AI agents you connect through MCP and the content prepared with the AI assistant are subject to this policy like any other use of your account.
7. Enforcement
We may, but are not required to, monitor the use of Kula to check that it follows this policy. When we find a breach, depending on its seriousness, we may:
- pause sending for a space or an account;
- ask you to show the consent of your contacts, or to remove contacts or content;
- suspend the account while we investigate;
- close the account, without refund, and keep the information needed to prevent new sign-ups.
Except in urgent cases, we contact you first and give you a chance to fix the issue.
8. Reporting abuse
If you received an email sent through Kula that you did not ask for, or that breaks this policy, forward it with its headers to support@kulamail.com. We read every report.
9. Changes
We may update this policy as email rules and laws evolve. We tell account owners by email of any change that requires them to act.
